Purpose: This regulation implements the provisions of M.G.L. c. 93H relative to the standards to be met by persons who own or license personal information about a resident of the Commonwealth of Massachusetts. This regulation establishes minimum standards to be met in connection with the safeguarding of personal information contained in both paper and electronic records.

Scope: The provisions of this regulation apply to all persons that own or license personal information about a resident of the Commonwealth.

Failure to comply with 201 CMR 17.00 could expose you to as much as $50,000.00 in fines and civil penalties in the event of the theft or improper storage and disposal of Personal Information as
defined by the new regulations.  Section 4 of the regulation allows a court to impose a $3,500 civil penalty for each violation.   In other words, each personal record lost or stolen may result in the $3,500.00 judgment.  How many personal records are on your laptop? Frequently Asked Questions

What constitutes personal information for a resident of Massachusetts?

The resident's first name and last name or first initial and last name in combination with any one or more of the following data elements that relate to such resident:

  • Social Security Number
  • Driver's license number or state-issued identification card number
  • Financial account number, or credit or debit card number, with or without any required security code, access code, personal identification number or password, that would permit access to a resident's financial account
